What this means for businesses: When a business opens an account or requests credit, we will ask for the business name, business address, Employer Identification Number, and other information that allows us to identify the business and signatories. The following disclosures are required by the Federal Electronic Signatures in Global and National Commerce Act (E-Signature Act). Please read the following Consent and Authorization disclosure and indicate your acceptance as instructed. We recommend that you print a copy of this disclosure and maintain a copy for your records.
The words “we”, “us”, and “our” means Broadway Bank and the words “you” and “your” means you, the individual(s) who is identified as the applicant, co-applicant, secondary applicant or borrower(s) on the Account(s).
Scope of Communications to Be Provided in Electronic Form. You agree to the acceptance of notices and disclosures in connection with your loan application by means of electronic delivery.
Your consent to receive electronic communications includes, but is not limited to:
Requesting Paper Copies. You understand and agree that you have a right to receive any required notices or disclosures in paper form as well as your right to withdraw your consent to have them delivered electronically. Once you have provided your consent to receive notices or disclosures electronically, you can still obtain paper copies of them by contacting us at (800) 531-7650.
Hardware and Software Requirements. In order to access our online systems and to receive the notices or disclosures electronically, you will need Internet access and an access device with recent versions of commonly used internet browsers including:
How to Update Your Records. You agree to notify Broadway Bank immediately of any change in your e-mail address by contacting us at (800) 531-7650.
How to Withdraw Consent. You understand and agree that you may withdraw consent by contacting us at (800) 531-7650. We may treat your provision of an invalid email address or the subsequent malfunction of a previously valid address as a withdrawal of your consent to receive electronic notices or disclosures. Any withdrawal of your consent to receive electronic notices or disclosures will be effective only after we have a reasonable period of time to process your withdrawal.
Statement in Writing. All notices or disclosures in either electronic or paper format from us to you will be considered “in writing”. You should print or download for your records a copy of your notices or disclosures, your initial authorization to receive notices or disclosures, and any changes to that authorization.
Federal Law. You acknowledge and agree that your consent to electronic notices or disclosures is being provided in connection with a transaction affecting interstate commerce that is subject to the federal Electronic Signatures in Global and National Commerce Act, and that you and we both intend that the Act apply to the fullest extent possible to validate our ability to conduct business with you by electronic means.
Consent and Authorization. By indicating your acceptance of these terms and conditions, you authorize Broadway Bank to deliver notices or disclosures to you electronically.
You understand and agree that Broadway Bank retains the right, to the extent permitted by law, to amend this agreement in the future by providing you with written notice of such changes to your last-known e-mail address. In the future, should Broadway Bank, by law or regulation, be permitted to deliver any additional notices or disclosures to which you are entitled besides those specifically listed herein, you hereby agree to receive such notices or disclosures in electronic format sent to your last-known e-mail address.
By indicating your acceptance of these terms and conditions, you authorize Broadway Bank to discontinue sending you such notices and disclosures via postal mail service for your account(s) and to instead deliver such notices and disclosures to you electronically. You understand and agree that Broadway Bank will send you an e-mail to your e-mail address notifying you that your notice or disclosure is ready to be viewed online or attached to the email.
